REPORT ON PART 8 OF THE PLANNING & DEVELOPMENT ACT, 2000 AND THE PLANNING AND DEVELOPMENT REGULATIONS 2001 – 2007.

Provision of Access Road and Services to Council owned lands at Clutterland off the Lucan – Newcastle Road (R120) to the West of Grange Castle Business Park.

The following Report was considered at the Lucan/Clondalkin area Committee Meeting (1) on Tuesday 18th September, 2007.

“REPORT ON PUBLIC CONSULTATION PROCEDURE UNDER PART 8 OF THE PLANNING & DEVELOPMENT ACT, 2000 AND THE PLANNING & DEVELOPMENT REGULATIONS 2001 & 2007 FOR THE PROVISION OF AN ACCESS ROAD AND SERVICES TO COUNCIL OWNED LANDS AT CLUTTERLAND OFF THE LUCAN-NEWCASTLE ROAD (R120) TO THE WEST OF GRANGE CASTLE BUSINESS PARK.

Part 8 of the Local Government Planning and Development Regulations, 2001-2007 prescribes the requirements in respect of certain classes of Local Authority Developments. These Regulations apply to the provision of an access road and services to Council owned lands at Clutterland off the Lucan-Newcastle Road (R120) to the west of Grange Castle Business Park. The nature and extent of the proposed development is as follows:-

Public Consultation Process.

The proposal was advertised in the Irish Independent on 17th May, 2007 and 10th July, 2007 (revisions to drawings) in accordance with Part 8 of the Planning and Development Regulations, 2001-2007 and was on public display at South Dublin County Council offices:-

County Hall, Town Centre, Tallaght, Dublin 24.

Civic Offices, Clondalkin, Dublin 22.

From Tuesday, 10th July, 2007 to Tuesday 21st August, 2007.

Any person wishing to make a submission or observation with respect to the proposed development dealing with the proper planning and sustainable development of the area in which the development is situated was invited to do so. The latest date for receipt of submissions was up to and including 5.00 p.m. on Tuesday 4th September, 2007.

List of Persons or bodies who made submissions or observations with respect to the proposed development:

Summary of main issues raised.

· Submission on behalf of the Mongan Family C/O Brophy Solicitors.

Observation 1 & 2.

That access to the residential site will be impossible after completion of the road works.

Council Response.

The detailed design makes provision for an entrance off the proposed road. This allows for safe and easy access and egress at all times during and after the construction process. The proposed scheme provides visibility and site lines, road markings, kerbing, footpaths, cycle ways, public lighting and an upgraded road carriageway.

The proposed access is to be a 9m carriageway that is standard to any housing development. The road will provide safe pedestrian and cycle access to all of the lands involved, it will be fully furnished with street lighting and appropriate road markings and signage.

Observation 3.

That the proposed road runs directly to the front of the residential site’s gate and the roundabout is to be placed approximately 10 metres from the front boundary.

Council’s Response.

A temporary secondary access road has been incorporated into the design, which will provide the Mongan family with access and will also move their existing temporary entrance off the R120 main road, thus providing a safe access and egress route from the residential site.

In addition, landscaping, pedestrian and cycle access routes are proposed for the temporary access, which will add further safety, privacy and comfort for the site.

The proposed roundabout is to be positioned approximately 170m from the access point of the residential site. A 10m strip of land is to surround the residential site, a boundary wall will be provided here with appropriate landscaping.

Observation 4 & 5

That the planning process for a bungalow, pillars, gates, six day houses and enterprise centre would proceed with three months of agreement made on 25th April, 2006.

Council’s Response.

The proposed Traveller Accommodation is a matter for the Housing Department and is being addressed in accordance with the Part 8 Procedure.

The proposed access road and services per this public procedure will enhance the serviceability and safe access/egress to the existing accommodation and any such future developments within the site will be subject to public consultation in accordance with the Part 8 Procedure and where appropriate the planning process.

Observation 6.

Location of a bus depot and recycling facility being placed in the vicinity of a residential site.

Council’s Response.

The development of a bus depot by Dublin Bus is proposed to service their fleet to the west and south of the Dublin Region, thus eliminating considerable journey times from existing depots to various termini in the South Dublin County area. The Council at its meeting held on the 11th June, 2007 noted the report in relation to the disposal of a 10 acres site to C.I.E/Dublin Bus Min No. C/0237/07 refers. Minute No C023707 - 11-06-07.shs The issues raised will be subject to consideration as part of the planning application by Dublin Bus for the site.

The Environmental Services Department are presently progressing plans for a civic amenity site on these zoned lands. Any such proposal will be subject to a separate Part 8 public consultation process.

The proposed access road development provides for servicing and access to the zoned lands west of the R120.

Observation 1.

Clarity of definition of private residential property.

Council Response.

The private residential property is separately outlined in red on the appended Drawing No. 02_028F_014. While the proposed scheme does not abut the private residence, landscaping and planting is included in the proposed scheme around the existing boundaries as shown shaded blue on Drawing No. 02_028F_014.

Observation 2.

Request that the property would be safe and secure with steel knife edge fencing, landscaping and screening.

Observation 3.

Querying the nature of the development to the north and south of the existing residential property on the subject lands.

Council’s Response.

These lands are part of the 30 acre land holding owned by the Council. The subject lands are zoned objective E, “Enterprise, Employment and Related Uses” in the current Development Plan 2004-2010 and will be developed in accordance with the objectives of the Development Plan.

Observation 4.

Concerns raised in relation to the proposed bus depot.

Observation 6.

What is the extent of the temporary access road.

Council’s Response.

The Council’s Roads Department are presently reviewing preliminary proposals for extending the existing Nangor Road westwards from the revised junction with the R120. This indicative proposed future road is indicated on the Part 8 appended drawings. When this future road is constructed, the existing proposed road from the R120 to the traveller accommodation site will be replaced with a road connection direct on to the new road to the west of the R120.

Recommendation.

These lands comprise a 30 acre landholding in the ownership of the Council. The proposed works are consistent with the proper planning and sustainable development of the area having regard to the zoning objective E “Enterprise and Employment and Related Uses” and the specific local objectives of the Development Plan, 2004-2010. It is recommended that the development works as proposed be proceeded with subject to the following 5 modifications:-

Modifications.

· The provision of a 3.5m wide temporary access off the proposed new road infrastructure for safe access and egress to the accommodation site. The final access to be completed as part of the proposed Western Road from the R120.

· The provision of landscaped acres along the boundary of the accommodation and residential sites.

· The provision of a pedestrian access to the accommodation site.

· The provision of a pedestrian crossing on the internal main carriageway to accommodate pedestrian and cycle access and egress for the accommodation site.

The recommendation of the Committee will be brought to the County Council Meeting for decision.”

Following consideration of the Report it was recommended by the Committee that the development as advertised should be proceeded with.

The proposed works are consistent with the proper planning and sustainable development of the area having regard to the Development Plan 2004-2010. Accordingly, it is now proposed to proceed with the development works as proposed.
