MOTION No. 2

MOTION: Councillor J. Daly

That this Council honour and complete the contract between South Dublin County Council and the Dublin County Board (GAA), which was agreed and paid for by the Dublin County Board in 1995, this means to transfer to the Dublin County Board the deeds and the lands which are legally theirs.

REPORT

The Council, following an approach by the Dublin County GAA Board, approved the disposal of 26 acres of land at Rathcoole in 1996 for the provision of playing pitches and dressing rooms to meet the growing playing needs of the population of this part of Dublin, subject to the following terms and conditions:

(1) That the full and final settlement shall be in the sum of IR£200,000.00
(two hundred thousand pounds).

(2) That the Council will dispose of its fee simple interest in the lands and
give vacant possession to the subject lands on completion.

(3) The sale shall be by way of contract providing for payment of 10% of the
purchase price on signing of the contract. The balance to be paid on
closing of the sale not exceeding two months from the signing of the
contract.

(4) The G.A.A. will be responsible for the provision of adequate boundary
fencing to the lands being disposed of and appropriate car parking
facilities.

(5) A right of way on the western side of the Council’s lands to access the
lands being disposed of will be granted.

(6) That no agreement enforceable at law is created or intended to be
created until exchange of contracts has taken place.

(7) That each party be responsible for its own respective legal costs of the
transaction.

The GAA County Board considered the lands to be very suitable to their needs.

The consideration of IR £200,000 was paid in full by the County Board subsequently.

The Council has been frustrated ever since in its endeavours to provide the right of way through its own lands.

On 14th March, 2007 the Council decided to make a Compulsory Purchase Order for the purposes of providing a new road from Stoney Lane and to serve the lands in question and submitted it to An Bord Pleanala for confirmation. 5 objections have been submitted to An Bord Pleanala by landowners included in the CPO before the closing date for objections – 2nd May 2007. The Board has set the 19th July 2007 as the date for the Oral Hearing on the CPO, following which the Board will consider its Inspectors report and advise the Council of its decision. The Council cannot proceed further with the road scheme until a positive decision in relation to the confirmation of the CPO is received.
