MOTION No. 8

MOTION: Councillor C. Keane

"That this Committee agrees that a 3 ton ban be imposed on the laneway to the rear of Muckross Ave. to prevent further damage to rear walls/laneway and indeed house extensions right beside this laneway, and also  condems the 'slipshod' repair that was carried out recently on this laneway to - it definatley is not up to SDCC standards, to state if this was contracted out and if so the follow up action on this? That the owner of the builders yard there be contacted and held responsible for the damage done by lorries to the freshly laid tarmac - now very dangerous with a large gaping hole. To state how and when this is going to be addressed. "

REPORT:

The imposition of a three tonne limit is not recommended in this instance, as it is an inappropriate traffic management measure for a short cul-de-sac laneway. The introduction of such a limit would serve no purpose in any case, as the only HGVs using the laneway are accessing the builder's yard, which is permissible under the relevant legislation governing such limits.

A temporary repair was carried out by a contractor to ensure the immediate safety of the public. This however was ineffective due to the HGV traffic using the laneway. Quotations for a more permanent repair are currently being sought and when available, a contractor will be nominated to carry out this work.

It would appear that the other issues raised in the Motion, insofar as they may  relate to this Council, should be more properly pursued under Planning legislation.
