QUESTION: Councillor J. Neville
" To ask the Manager to outline Council policy in relation to the purchase of a duplex apartment in the Avonbeg area by a Council tenant where the resident of the other apartment is a Council tenant and has indicated that they wish to remain so, i.e could half the duplex be privately owned?"
REPLY
Under the terms of the Tenant Purchase Scheme 1995 the Council are not in a position to sell dwelling units of this nature.Section 13 of the Regulations states as follows: A Housing Authority shall not sell a dwelling which "is a separate and self contained flat in a premises, divided into two or more flats, which would require arrangements for the upkeep and management of common areas, works or services other than by the purchaser".
As a result of an application from a tenant at this location the Council recently sought the advice of the Department of the Environment and Local Government who confirmed that this was indeed the case at present. However, the Department have advised the Council that a new scheme is currently being drawn up which may enable tenants of such units the opportunity of purchasing their dwellings if they so wish.
