QUESTION: Councillor M. Árdagh

To ask the Manager for an update on the Enforcement Proceedings in relation to file No. S4754.

REPLY

Written complaints were received by Planning Enforcement in relation to an alleged unauthorised development taking place on lands adjacent to the Walkinstown Roundabout, in that a Van Sales business was operating on the lands without the benifit of planning permission.

In this regard, a Warning Letter dated 24th August 2006 pursuant to Section 152 of the Planning and Development Act, 2000 was served on the owner and occupier of the lands.

Futher complaints were received alleging that run off water from the washing of vehicles by the occupiers of the lands was discharging into public drains.  This particular matter was referred to the Environmental Health Officer and Environmental Services for investigation.  The Water Pollution Engineer has reported that no evidence of car washing or run-off water could be found during an inspection of the lands.

The lands have been reinspected and the Planning Inspector's report and recommendation is currently under consideration.  A decision on the service of an Enforcement Notice will be made shortly.

The Councillor will be kept informed as this investigation progresses.
