9 Cloonmore Park, Jobstown

A complaint was received by Planning Enforcement on 12th October 2006 in relation to the creation of a hardstanding area and the placing of mobile homes / caravans on the lands within the curtilage of 9 Cloonmore Park, Jobstown.

A Warning Letter pursuant to Section 152 of the Planning and Development Act, 2000 was served on the owner of this property on 13th October 2006.  As a person served with a Warning Letter, he/ she may make submissions or observations in writing to the Planning Authority regarding the alleged unauthorised development not later than four weeks from the date of the service of the Warning Letter i.e.14th November 2006.  No submissions have been received in this regard.

Further investigations are being carried out.  Once the Planning Inspector’s report is to hand, should the Planning Authority, consider that the above described or other unauthorised development has been/is being/may be carried out, it may decide to issue an Enforcement Notice under Section 154 of the Planning & Development Act 2000.

Any person who has carried out or who is carrying out unauthorised development may be guilty of an offence under Section 151 of the Planning & Development Act 2000 and shall be liable to a fine or a term of imprisonment.  The owner of the above lands have been advised accordingly.

During the course of the investigation by Planning Enforcement, the following must be borne in mind;

Under Class 8, Schedule 2, Part 1, Planning & Development Regulations 2001, the keeping or storing of a caravan, campervan or boat within the curtilage of a house can be considered to be exempted development providing that:-

1. Not more than one caravan, campervan or boat shall be so kept or stored

2. The caravan, campervan or boat shall not be used for the storage, display, advertisement or sale of goods or for the purposes of any business

3.  No caravan, campervan or boat shall be so kept or stored for more than 9 months in any year or occupied as a dwelling while so kept or stored.
